ARTIKEL 1 – IDENTITEIT VAN DE ORGANISATOR
Deze algemene voorwaarden worden gebruikt door:

Hierna: “Afroton” of “wij”.
ARTIKEL 2 – TOEPASSINGSGEBIED
2.1. Deze voorwaarden zijn van toepassing op elke bestelling, reservatie, aankoop en elk bezoek aan een evenement georganiseerd door Afroton, ongeacht via welk kanaal de bestelling gebeurt.
2.2. Door een bestelling te plaatsen en het vakje “ik aanvaard de algemene voorwaarden” aan te vinken, aanvaardt de Klant deze voorwaarden integraal. Zonder die aanvaarding kan de bestelling niet worden afgerond.
2.3. Afwijkingen zijn enkel geldig als Afroton ze schriftelijk en uitdrukkelijk heeft bevestigd. Eventuele algemene voorwaarden van de Klant zijn niet van toepassing.
2.4. Als de Klant een consument is in de zin van Boek I van het Wetboek van Economisch Recht, doen deze voorwaarden geen afbreuk aan de dwingende rechten die de Klant op grond van de wet geniet.
ARTIKEL 3 – DEFINITIES
Klant: de natuurlijke of rechtspersoon die een bestelling plaatst of een overeenkomst aangaat met Afroton.
Bezoeker: iedere persoon die zich op het evenementterrein bevindt, ongeacht of hij of zij zelf het ticket heeft gekocht.
Ticket: een toegangsbewijs, in digitale of gedrukte vorm, dat toegang geeft tot een door Afroton georganiseerd evenement, inclusief eventuele parkeer-, camping- of consumptietickets.
Evenement: elk concert, festival, clubavond of andere activiteit georganiseerd door Afroton.
Overeenkomst: de bindende afspraak tussen Afroton en de Klant.
Tickoweb: de externe dienstverlener die het ticketingplatform levert.
ARTIKEL 4 – ROL VAN AFROTON EN TICKOWEB
4.1. Afroton is de organisator van het evenement en de verkoper van de tickets. Afroton is de contractspartij van de Klant.
4.2. Tickoweb treedt uitsluitend op als technische dienstverlener, in naam en voor rekening van Afroton. Tickoweb is geen partij bij de overeenkomst tussen de Klant en Afroton en is niet verantwoordelijk voor de inhoud of de uitvoering van het evenement.
4.3. Op de verwerking van betalingen kunnen daarnaast de voorwaarden en het privacybeleid van Tickoweb en van de betaaldienstverlener van toepassing zijn.
4.4. De persoon die de bestelling plaatst, wordt beschouwd als opdrachtgever en blijft verantwoordelijk voor de correcte betaling, ook wanneer de tickets aan derden worden doorgegeven.
ARTIKEL 5 – TOTSTANDKOMING VAN DE OVEREENKOMST
5.1. De overeenkomst komt tot stand op het moment dat de Klant de bestelling bevestigt, deze voorwaarden aanvaardt en Afroton of Tickoweb de bestelling per e-mail bevestigt.
5.2. Afroton mag een bestelling weigeren of annuleren bij een vermoeden van fraude, misbruik, doorverkoop met winstoogmerk, of bij een kennelijke prijs- of systeemfout. In dat geval worden reeds betaalde bedragen terugbetaald.
5.3. Afroton mag een maximum aantal tickets per persoon of per bestelling opleggen. Bestellingen die dat maximum overschrijden, kunnen geheel of gedeeltelijk worden geannuleerd.
ARTIKEL 6 – PRIJZEN, KOSTEN EN BETALING
6.1. Alle prijzen zijn in euro en inclusief btw. Eventuele servicekosten worden duidelijk apart vermeld tijdens het bestelproces en zijn opgenomen in het totaalbedrag dat de Klant ziet vóór de definitieve bevestiging. De Klant betaalt nooit meer dan het getoonde totaalbedrag.
6.2. De bestelling dient volledig te worden betaald binnen de bij de bestelling vermelde termijn. Bij niet-tijdige betaling mag Afroton de bestelling annuleren zonder verdere ingebrekestelling.
6.3. Servicekosten zijn niet terugbetaalbaar, behalve wanneer een evenement door Afroton wordt geannuleerd en er geen alternatieve datum wordt aangeboden.
6.4. Bij een terugbetaling gebeurt de storting op dezelfde betaalmethode als die van de oorspronkelijke betaling, tenzij anders overeengekomen.
ARTIKEL 7 – LEVERING EN GELDIGHEID VAN TICKETS
7.1. Tickets worden pas verzonden na ontvangst van de volledige betaling.
7.2. Tickets worden standaard als e-ticket geleverd op het e-mailadres dat de Klant heeft opgegeven. De Klant is verantwoordelijk voor de juistheid van dat adres. Afroton raadt aan om ook de spam- of reclamemap te controleren.
7.3. Heeft de Klant zijn tickets niet ontvangen ten laatste vier dagen vóór het evenement, dan neemt hij onmiddellijk contact op via hi@roslar.eu.
7.4. Een e-ticket, getoond op een smartphone of afgedrukt op wit papier, is het enige geldige toegangsbewijs. Het ticket is enkel geldig voor het evenement en de datum die erop vermeld staan.
7.5. De QR-code of barcode moet volledig, onbeschadigd en scanbaar zijn. Elk ticket bevat een unieke code die slechts één keer kan worden gescand. Bij een dubbele scan verleent enkel de eerste scan toegang. Wie zich met een reeds gescand ticket aanbiedt, krijgt geen toegang en heeft geen recht op terugbetaling.
7.6. De Klant gaat zorgvuldig om met zijn ticket en deelt de QR-code niet publiek, ook niet op sociale media. Tickets worden niet vervangen of terugbetaald bij verlies, beschadiging of diefstal.
7.7. Misbruik, namaak of fraude leidt tot weigering van toegang zonder recht op compensatie, en kan aanleiding geven tot gerechtelijke vervolging.
ARTIKEL 8 – HERROEPINGSRECHT
8.1. Overeenkomstig artikel VI.53, 12° van het Wetboek van Economisch Recht beschikt de Klant niet over het wettelijk herroepingsrecht van 14 dagen. Het gaat hier om diensten met betrekking tot vrijetijdsbesteding waarvoor in de overeenkomst een specifieke datum of periode van uitvoering is voorzien.
8.2. Tickets kunnen bijgevolg niet worden geruild, geannuleerd of terugbetaald, behalve in de gevallen die uitdrukkelijk in artikel 10 zijn beschreven.
ARTIKEL 9 – DOORVERKOOP EN OVERDRACHT
9.1. Doorverkoop van tickets is onderworpen aan de wet van 30 juli 2013 betreffende de verkoop van toegangsbewijzen tot evenementen. Regelmatige doorverkoop is verboden, en occasionele doorverkoop mag nooit gebeuren aan een prijs die hoger ligt dan de oorspronkelijke totaalprijs.
9.2. Afroton erkent TicketSwap als enige officiële doorverkoopplatform. Tickets die via andere kanalen worden verkregen, kunnen ongeldig worden verklaard zonder recht op terugbetaling.
9.3. Tickets mogen niet worden gebruikt voor commerciële of promotionele doeleinden (wedstrijden, weggeefacties, bundels) zonder voorafgaande schriftelijke toestemming van Afroton.
ARTIKEL 10 – ANNULERING, VERPLAATSING EN PROGRAMMAWIJZIGING
10.1. Annulering door Afroton. Wordt een evenement volledig geannuleerd, dan wordt de nominale ticketprijs terugbetaald. De Klant hoeft daarvoor niets te doen tenzij anders gecommuniceerd. Servicekosten worden in dat geval eveneens terugbetaald.
10.2. Verplaatsing. Wordt een evenement verplaatst naar een andere datum of locatie, dan blijven de tickets automatisch geldig voor de nieuwe datum. Kan de Klant er niet bij zijn, dan kan hij binnen 14 kalenderdagen na de aankondiging van de nieuwe datum een terugbetaling van de nominale ticketprijs aanvragen via hi@roslar.eu. Na die termijn vervalt dat recht.
10.3. Programmawijziging. Afroton mag de line-up, het tijdschema, de indeling van het terrein of de capaciteit wijzigen. Het wegvallen of vervangen van één of meerdere artiesten geeft geen recht op terugbetaling of compensatie, zolang het evenement in zijn geheel doorgaat.
10.4. Onderbreking. Wordt een evenement na aanvang onderbroken of vroegtijdig beëindigd om redenen van veiligheid, overmacht of op bevel van de overheid, dan bestaat er geen recht op terugbetaling.
10.5. In geen geval worden bijkomende kosten van de Klant terugbetaald, zoals vervoer, parking, accommodatie of verlofdagen.
10.6. Terugbetalingen gebeuren binnen 30 kalenderdagen na de datum waarop het recht op terugbetaling vaststaat.
ARTIKEL 11 – TOEGANG EN HUISREGELS
11.1. Toegang is enkel mogelijk met een geldig ticket en, indien van toepassing, een geldig identiteitsbewijs.
11.2. Voor evenementen met een leeftijdsgrens (vermeld bij het evenement) kan Afroton een identiteitsbewijs vragen. Wie de leeftijdsgrens niet kan aantonen, krijgt geen toegang en heeft geen recht op terugbetaling.
11.3. Overeenkomstig de Belgische wetgeving worden geen alcoholische dranken geschonken aan personen jonger dan 16 jaar, en geen sterkedrank aan personen jonger dan 18 jaar.
11.4. Bij het betreden van het terrein kan de Bezoeker worden gevraagd zijn tassen en kledij te laten controleren door de veiligheidsdienst. Wie die controle weigert, krijgt geen toegang.
11.5. Het is verboden om onder meer het volgende mee te brengen: drugs en andere illegale middelen, wapens en gevaarlijke voorwerpen, eigen drank of etenswaren, glas, blik, spuitbussen, vuurwerk, en professionele foto-, film- of geluidsapparatuur zonder accreditatie. Dieren zijn niet toegelaten, met uitzondering van assistentiehonden.
11.6. Afroton hanteert een nultolerantie voor drugs, geweld, diefstal, discriminatie, racisme en elke vorm van grensoverschrijdend gedrag. Bezoekers die zich hieraan schuldig maken, worden zonder terugbetaling van het terrein verwijderd en kunnen de toegang tot toekomstige evenementen worden ontzegd.
11.7. Bezoekers volgen de aanwijzingen van de organisatie, de veiligheidsdienst en de hulpdiensten op.
11.8. Wie het terrein verlaat, heeft geen automatisch recht op herbetreding, tenzij dit uitdrukkelijk zo is gecommuniceerd.
ARTIKEL 12 – VEILIGHEID EN GEZONDHEID
12.1. Op onze evenementen kunnen geluidsniveaus voorkomen die conform de Vlaamse geluidsnormen zijn maar bij langdurige blootstelling gehoorschade kunnen veroorzaken. Afroton stelt gehoorbescherming ter beschikking en raadt het gebruik ervan sterk aan. Het gebruik ervan is de verantwoordelijkheid van de Bezoeker.
12.2. Op sommige evenementen worden lichteffecten, stroboscopen of rookmachines gebruikt. Bezoekers met epilepsie, ademhalingsproblemen of andere gezondheidsrisico’s nemen dit in overweging.
12.3. Bezoekers betreden het terrein op eigen risico.
ARTIKEL 13 – BEELD- EN GELUIDSOPNAMES
13.1. Tijdens onze evenementen worden foto’s en video-opnames gemaakt voor communicatie- en promotiedoeleinden.
13.2. Sfeerbeelden waarop bezoekers niet individueel herkenbaar centraal in beeld staan, worden gepubliceerd op grond van het gerechtvaardigd belang van Afroton. Voor gerichte portretbeelden vragen wij vooraf toestemming.
13.3. Wie niet in beeld wil komen, kan dit ter plaatse melden aan de fotograaf of achteraf een verwijderingsverzoek richten aan hi@roslar.eu. Wij verwijderen het beeld dan zo snel als redelijkerwijs mogelijk uit onze eigen kanalen.
13.4. Het is verboden om zonder schriftelijke toestemming beeld- of geluidsopnames van optredens te maken met professionele apparatuur, of om dergelijke opnames commercieel te exploiteren.
ARTIKEL 14 – AANSPRAKELIJKHEID
14.1. Afroton is niet aansprakelijk voor verlies, diefstal of beschadiging van persoonlijke bezittingen van Bezoekers.
14.2. Afroton is niet aansprakelijk voor indirecte schade, zoals gederfde winst, gemiste kansen, reis-, parkeer- of verblijfskosten.
14.3. Behalve in de gevallen vermeld in artikel 14.4 is de totale aansprakelijkheid van Afroton per Klant beperkt tot het bedrag dat de Klant voor de betrokken tickets heeft betaald.
14.4. Niets in deze voorwaarden sluit de aansprakelijkheid van Afroton uit of beperkt deze voor: overlijden of lichamelijk letsel veroorzaakt door een fout van Afroton of haar aangestelden; bedrog, opzet of zware fout; en elke andere aansprakelijkheid die krachtens dwingend recht niet kan worden uitgesloten.
14.5. De Klant is aansprakelijk voor schade die hij of de personen aan wie hij zijn tickets heeft overgedragen, veroorzaken aan Afroton, aan de locatie of aan derden.
ARTIKEL 15 – OVERMACHT
15.1. Afroton is niet aansprakelijk voor de niet-uitvoering of de vertraagde uitvoering van haar verbintenissen als gevolg van overmacht.
15.2. Onder overmacht wordt onder meer verstaan: natuurrampen en extreme weersomstandigheden, epidemieën en pandemieën, brand, oorlog, terreurdreiging, stakingen, stroom- of netwerkuitval, sabotage, beslissingen of verbodsmaatregelen van de overheid, en de onbeschikbaarheid van de locatie of van essentiële artiesten of leveranciers buiten de wil van Afroton om.
15.3. In geval van overmacht streeft Afroton er in de eerste plaats naar het evenement te verplaatsen. Artikel 10.2 is dan van toepassing.
ARTIKEL 16 – PERSOONSGEGEVENS
16.1. Afroton vzw is verwerkingsverantwoordelijke voor de persoonsgegevens die zij verwerkt in het kader van ticketverkoop, evenementorganisatie en communicatie.
16.2. Wij verwerken persoonsgegevens conform de Algemene Verordening Gegevensbescherming (AVG) en de Belgische privacywetgeving. De volledige informatie over welke gegevens wij verwerken, op welke rechtsgrond, hoe lang wij ze bewaren en met wie wij ze delen, staat in onze privacyverklaring op www.roslar.eu/privacy.
16.3. Marketing. Wij sturen enkel commerciële e-mails naar wie zich daarvoor uitdrukkelijk heeft ingeschreven. Bestaande klanten kunnen daarnaast informatie ontvangen over gelijkaardige eigen evenementen, overeenkomstig artikel XII.13 van het Wetboek van Economisch Recht. Elke mailing bevat een uitschrijflink, en uitschrijven kan ook altijd via hi@roslar.eu.
16.4. De Klant heeft het recht op inzage, verbetering, verwijdering, beperking, overdraagbaarheid en bezwaar. Verzoeken kunnen worden gericht aan hi@roslar.eu.
16.5. De Klant kan een klacht indienen bij de Gegevensbeschermingsautoriteit, Drukpersstraat 35, 1000 Brussel, contact@apd-gba.be.
16.6. De Klant garandeert dat de opgegeven gegevens correct en volledig zijn.
ARTIKEL 17 – INTELLECTUELE EIGENDOM
17.1. Alle teksten, beelden, logo’s, huisstijl, video’s en andere content gepubliceerd door Afroton zijn beschermd door het auteursrecht en andere intellectuele eigendomsrechten. Zij mogen niet worden gekopieerd, gewijzigd, gepubliceerd of verspreid zonder voorafgaande schriftelijke toestemming.
17.2. De naam en het logo van Afroton mogen niet worden gebruikt zonder toestemming.
ARTIKEL 18 – KLACHTEN EN GESCHILLEN
18.1. Klachten over een bestelling of een evenement worden bij voorkeur binnen 14 kalenderdagen gemeld via hi@roslar.eu. Wij bevestigen de ontvangst en streven ernaar binnen 30 kalenderdagen inhoudelijk te antwoorden.
18.2. Komen wij er samen niet uit, dan kan de consument zich gratis wenden tot de Consumentenombudsdienst, Koning Albert II-laan 8 bus 1, 1000 Brussel, www.consumentenombudsdienst.be.
18.3. Op deze voorwaarden is uitsluitend het Belgisch recht van toepassing.
18.4. Geschillen met een Klant die geen consument is, worden uitsluitend beslecht door de bevoegde rechtbanken van het gerechtelijk arrondissement West-Vlaanderen, afdeling Kortrijk. Voor geschillen met een consument gelden de wettelijke regels inzake territoriale bevoegdheid.
ARTIKEL 19 – WIJZIGING VAN DE VOORWAARDEN
19.1. Afroton mag deze voorwaarden wijzigen. De versie die van toepassing is, is steeds die welke op het moment van de bestelling op de website stond en die de Klant heeft aanvaard.
19.2. De actuele versie en de versiedatum zijn steeds raadpleegbaar op www.roslar.eu.
ARTIKEL 20 – SLOTBEPALINGEN
20.1. Is een bepaling van deze voorwaarden nietig, ongeldig of niet-afdwingbaar, dan blijven de overige bepalingen onverkort van kracht. De nietige bepaling wordt vervangen door een geldige bepaling die de oorspronkelijke bedoeling zo dicht mogelijk benadert.
20.2. Het niet of laattijdig uitoefenen van een recht door Afroton houdt geen afstand van dat recht in.
20.3. De Nederlandstalige versie van deze voorwaarden is de enige rechtsgeldige versie. Vertalingen worden louter ter informatie aangeboden.
ARTICLE 1 – IDENTITY OF THE ORGANISER

Hereinafter referred to as: “Afroton” or “we”.
ARTICLE 2 – SCOPE OF APPLICATION
2.1. These terms and conditions apply to every order, reservation, purchase, and visit to any event organised by Afroton, regardless of the channel through which the order is placed.
2.2. By placing an order and checking the box “I accept the terms and conditions”, the Customer accepts these terms and conditions in full. Without this acceptance, the order cannot be completed.
2.3. Deviations are valid only if Afroton has explicitly confirmed them in writing. Any general terms and conditions of the Customer shall not apply.
2.4. If the Customer is a consumer within the meaning of Book I of the Belgian Code of Economic Law (Wetboek van Economisch Recht), these terms and conditions do not affect the mandatory statutory rights enjoyed by the Customer under applicable law.
ARTICLE 3 – DEFINITIONS
- Customer: The natural person or legal entity placing an order or entering into an agreement with Afroton.
- Visitor: Any person present at the event site, regardless of whether they purchased the ticket themselves.
- Ticket: An admission ticket, in digital or printed format, granting access to an event organised by Afroton, including any parking, camping, or voucher/consumption tickets.
- Event: Any concert, festival, club night, or other activity organised by Afroton.
- Agreement: The binding agreement between Afroton and the Customer.
- Tickoweb: The third-party service provider supplying the ticketing platform.
ARTICLE 4 – ROLE OF AFROTON AND TICKOWEB
4.1. Afroton is the organiser of the event and the seller of the tickets. Afroton is the contracting party of the Customer.
4.2. Tickoweb acts solely as a technical service provider, in the name and on behalf of Afroton. Tickoweb is not a party to the agreement between the Customer and Afroton and is not responsible for the content or execution of the event.
4.3. The terms and privacy policy of Tickoweb and the relevant payment service provider may also apply to the processing of payments.
4.4. The person placing the order is considered the principal and remains responsible for correct payment, even if tickets are transferred to third parties.
ARTICLE 5 – FORMATION OF THE AGREEMENT
5.1. The agreement is concluded at the moment the Customer confirms the order, accepts these terms and conditions, and Afroton or Tickoweb confirms the order by e-mail.
5.2. Afroton reserves the right to refuse or cancel an order in the event of suspected fraud, abuse, resale for commercial gain, or in the case of an obvious price or system error. In such cases, any amounts already paid will be refunded.
5.3. Afroton may impose a maximum number of tickets per person or per order. Orders exceeding this maximum may be cancelled in whole or in part.
ARTICLE 6 – PRICES, FEES, AND PAYMENT
6.1. All prices are in euros (€) and inclusive of VAT. Any service fees will be clearly listed separately during the ordering process and included in the total amount displayed to the Customer prior to final confirmation. The Customer will never pay more than the total amount displayed.
6.2. The order must be paid in full within the time limit specified during ordering. In the event of late payment, Afroton may cancel the order without further notice of default.
6.3. Service fees are non-refundable, except where an event is cancelled by Afroton and no alternative date is offered.
6.4. Refunds will be issued using the same payment method used for the original transaction, unless agreed otherwise.
ARTICLE 7 – DELIVERY AND VALIDITY OF TICKETS
7.1. Tickets will only be dispatched upon receipt of full payment.
7.2. Tickets are delivered by default as e-tickets to the e-mail address provided by the Customer. The Customer is responsible for the accuracy of this address. Afroton advises checking spam or junk folders.
7.3. If the Customer has not received their tickets at least four days before the event, they must immediately contact Afroton via hi@roslar.eu.
7.4. An e-ticket displayed on a smartphone or printed on white paper constitutes the only valid proof of admission. The ticket is valid exclusively for the event and date stated on it.
7.5. The QR code or barcode must be complete, undamaged, and scannable. Each ticket contains a unique code that can only be scanned once. In the event of duplicate scans, only the first scan will be granted admission. Anyone presenting a ticket that has already been scanned will be denied entry without right to a refund.
7.6. The Customer must treat their ticket with care and must not share the QR code publicly, including on social media. Tickets will not be replaced or refunded in the event of loss, damage, or theft.
7.7. Abuse, forgery, or fraud will result in refusal of entry without right to compensation and may lead to legal prosecution.
ARTICLE 8 – RIGHT OF WITHDRAWAL
8.1. In accordance with Article VI.53, 12° of the Belgian Code of Economic Law, the Customer does not possess a statutory 14-day right of withdrawal. This concerns services related to leisure activities providing for a specific date or period of performance in the agreement.
8.2. Consequently, tickets cannot be exchanged, cancelled, or refunded, except in the circumstances explicitly set out in Article 10.
ARTICLE 9 – RESALE AND TRANSFER
9.1. The resale of tickets is subject to the Belgian Act of 30 July 2013 regarding the sale of admission tickets to events. Systematic or regular resale is prohibited, and occasional resale may never occur at a price higher than the original total price.
9.2. Afroton recognizes TicketSwap as its sole official resale platform. Tickets obtained through other channels may be declared invalid without right to a refund.
9.3. Tickets may not be used for commercial or promotional purposes (e.g. competitions, giveaways, package deals) without the prior written consent of Afroton.
ARTICLE 10 – CANCELLATION, RESCHEDULING, AND PROGRAMME CHANGES
10.1. Cancellation by Afroton: If an event is cancelled in its entirety, the face value of the ticket will be refunded. The Customer does not need to take action unless communicated otherwise. Service fees will also be refunded in this case.
10.2. Rescheduling: If an event is rescheduled to another date or location, tickets remain automatically valid for the new date. If the Customer is unable to attend, they may request a refund of the ticket face value via hi@roslar.eu within 14 calendar days following the announcement of the new date. After this period, that right lapses.
10.3. Programme Changes: Afroton reserves the right to alter the line-up, timetable, venue layout, or capacity. The cancellation or replacement of one or more artists does not entitle the Customer to a refund or compensation, provided the event as a whole takes place.
10.4. Interruption: If an event is interrupted or ended early after commencement for safety reasons, force majeure, or by order of official authorities, no right to a refund shall exist.
10.5. Under no circumstances will additional costs incurred by the Customer be reimbursed, such as transportation, parking, accommodation, or annual leave.
10.6. Refunds will be processed within 30 calendar days following the date on which the right to a refund is established.
ARTICLE 11 – ADMISSION AND HOUSE RULES
11.1. Admission is possible only upon presentation of a valid ticket and, where applicable, a valid government-issued ID.
11.2. For events subject to an age limit (stated at the event page/ticket), Afroton may request proof of identity. Anyone unable to demonstrate compliance with the age limit will be refused entry without right to a refund.
11.3. In accordance with Belgian legislation, no alcoholic beverages will be served to persons under 16 years of age, and no spirits to persons under 18 years of age.
11.4. Upon entering the premises, Visitors may be asked by security staff to submit their bags and clothing to a search. Anyone refusing a search will be denied entry.
11.5. Prohibited items include, but are not limited to: illegal drugs and substances, weapons and dangerous objects, outside food or drink, glass, cans, aerosols, fireworks, and professional audio/video recording equipment without accreditation. Animals are not permitted, with the exception of certified assistance dogs.
11.6. Afroton enforces a zero-tolerance policy regarding drugs, violence, theft, discrimination, racism, and any form of misconduct or inappropriate behavior. Visitors guilty of such actions will be removed from the premises without a refund and may be banned from future events.
11.7. Visitors must comply with instructions given by event staff, security personnel, and emergency services.
11.8. Visitors who leave the event site have no automatic right to re-entry, unless explicitly communicated otherwise.
ARTICLE 12 – SAFETY AND HEALTH
12.1. Sound levels at our events comply with Flemish noise regulations, but prolonged exposure may cause hearing damage. Afroton provides hearing protection on site and strongly recommends its use. Use of hearing protection is the sole responsibility of the Visitor.
12.2. Lighting effects, stroboscopes, or smoke machines may be used at certain events. Visitors with epilepsy, respiratory conditions, or other health risks should take this into consideration.
12.3. Visitors enter the venue at their own risk.
ARTICLE 13 – MEDIA AND RECORDINGS
13.1. Photos and audio/video recordings may be made during our events for communication and promotional purposes.
13.2. General crowd imagery where visitors are not individually identifiable or central to the picture is published on the basis of Afroton’s legitimate interest. For targeted individual portraits, prior consent will be requested.
13.3. Anyone who does not wish to be photographed or filmed can notify the photographer on site or submit a removal request afterwards to hi@roslar.eu. We will remove the image from our own channels as quickly as reasonably possible.
13.4. Making audio or video recordings of performances using professional equipment or commercially exploiting such recordings without prior written permission is strictly prohibited.
ARTICLE 14 – LIABILITY
14.1. Afroton is not liable for loss, theft, or damage to personal belongings of Visitors.
14.2. Afroton is not liable for indirect damages, such as lost profits, missed opportunities, travel, parking, or accommodation expenses.
14.3. Except in the cases mentioned in Article 14.4, Afroton’s total aggregate liability per Customer is limited to the total amount paid by the Customer for the relevant tickets.
14.4. Nothing in these terms and conditions excludes or limits Afroton’s liability for: death or personal injury caused by negligence of Afroton or its agents; fraud, willful misconduct, or gross negligence; or any other liability that cannot be excluded under mandatory law.
14.5. The Customer is liable for any damage caused by them or by persons to whom they transferred their tickets, to Afroton, the venue, or third parties.
ARTICLE 15 – FORCE MAJEURE
15.1. Afroton shall not be liable for non-performance or delayed performance of its obligations due to force majeure.
15.2. Force majeure includes, but is not limited to: natural disasters and extreme weather conditions, epidemics and pandemics, fire, war, threat of terrorism, strikes, power or network failures, sabotage, governmental decisions or prohibitions, and the unavailability of the venue or essential artists or suppliers beyond Afroton’s reasonable control.
15.3. In the event of force majeure, Afroton will primarily endeavour to reschedule the event. Article 10.2 shall apply in such cases.
ARTICLE 16 – PERSONAL DATA
16.1. Afroton vzw is the data controller for personal data processed in connection with ticket sales, event organization, and communications.
16.2. We process personal data in accordance with the General Data Protection Regulation (GDPR) and Belgian privacy laws. Full information regarding the data we process, the legal bases, retention periods, and third-party sharing is available in our privacy policy at www.roslar.eu/privacy.
16.3. Marketing: We only send commercial e-mails to individuals who have explicitly opted in. Existing customers may also receive information regarding similar events hosted by us, in accordance with Article XII.13 of the Code of Economic Law. Every mailing contains an unsubscribe link, and unsubscription can also be requested at any time via hi@roslar.eu.
16.4. The Customer has rights of access, rectification, erasure, restriction, data portability, and objection. Requests can be sent to hi@roslar.eu.
16.5. The Customer may lodge a complaint with the Data Protection Authority (Gegevensbeschermingsautoriteit), Drukpersstraat 35, 1000 Brussels, contact@apd-gba.be.
16.6. The Customer guarantees that all provided details are correct and complete.
ARTICLE 17 – INTELLECTUAL PROPERTY
17.1. All text, images, logos, branding, video content, and other material published by Afroton are protected by copyright and other intellectual property rights. They may not be copied, modified, published, or distributed without prior written consent.
17.2. The name and logo of Afroton may not be used without prior written authorization.
ARTICLE 18 – COMPLAINTS AND DISPUTES
18.1. Complaints regarding an order or an event should preferably be reported within 14 calendar days via hi@roslar.eu. We will acknowledge receipt and endeavor to provide a substantive response within 30 calendar days.
18.2. If a dispute cannot be resolved amicably, consumers may contact the Consumer Mediation Service (Consumentenombudsdienst) free of charge: Koning Albert II-laan 8 bus 1, 1000 Brussels, www.consumentenombudsdienst.be.
18.3. These terms and conditions are governed exclusively by Belgian law.
18.4. Any disputes with a Customer who is not a consumer shall be subject to the exclusive jurisdiction of the competent courts of the judicial district of West Flanders, Kortrijk division. For disputes involving consumers, statutory rules on territorial jurisdiction shall apply.
ARTICLE 19 – AMENDMENTS TO TERMS AND CONDITIONS
19.1. Afroton reserves the right to amend these terms and conditions. The applicable version is always the version available on the website at the time of order placement and accepted by the Customer.
19.2. The current version and version date are available at all times on www.roslar.eu.
ARTICLE 20 – FINAL PROVISIONS
20.1. If any provision of these terms and conditions is held to be void, invalid, or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by a valid provision that approximates the original intent as closely as possible.
20.2. Failure or delay by Afroton in exercising any right under these terms shall not constitute a waiver of such right.
20.3. The Dutch version of these terms and conditions is the sole legally binding version. Translations are provided for informational purposes only.
